Definitions
Customer – The client, Company or representative of the company, who compensates Avanti Networks Inc., for services rendered.
Avanti Networks Inc. – Avanti Networks Inc, Avanti Networks, Employees of Avanti Networks Inc.
Service or Services – Services Provided by Avanti Networks and Third Parties, which include, Virus Removal, Spyware Removal, Malware Removal, Computer Repair, Computer Service, Remote Support, Network Support, Database Development, Web Design, Backup Services, file sync, Consultation, Web Hosting, Email Services, Working with Partners such as Gillware, Efolder, Dell, HP, Group Spark, TCG, Rackspace, Square etc, .
The following are the terms and conditions for use of Avanti Networks Inc. services. Please read them carefully. Our service is offered to you with the condition that you accept without modification the terms and conditions contained herein. Avanti Networks Inc., may change these Terms of Service at any time, with or without notice. Accordingly, you should return to this Website often to check for changes to the Terms of Services. You understand that by using the service after a change becomes effective, you have agreed to it. By obtaining services from Avanti Networks Inc., you are indicating your agreement to be bound by all of the terms and conditions set forth in this document.
These terms and conditions state important requirements regarding your use of Avanti Networks Inc. computer support service and other Services (see Definitions) and your relationship with Avanti Networks Inc. You should read them carefully as they contain important information regarding your rights and ours.
1. General
These Terms of Service (the “Agreement”) are entered into by and between you, the customer (personally and/or on behalf of your employer, as applicable) (“you”, “your” or “Subscriber”) and Avanti Networks Inc. and it’s services, (see Definitions) “us” or “we”). You are deemed to have accepted this Agreement upon the earlier of: (i) your submission of an online or telephone request for service; (ii) your accepting the Terms of Service electronically during registration or in the course of initiating a support session whether online, by telephone or on-site; or (iii) your use of the Service. This Agreement is made up of the terms below, plus the Privacy Policy, all attachments to this Agreement, and the other policies and materials specifically referred to in these Terms of Service, all of which are incorporated herein by reference. The Agreement and related policies are also set forth on the Avanti Networks Inc. services terms of services on website (www.avantinetworks.com) (“Website”). The Agreement sets forth the terms and conditions under which you agree to use the Service, and under which Avanti Networks Inc. agrees to provide the Service to you.
2. Definition of Service
For purposes of this Agreement, the term “service” shall mean (Virus Removal, Spyware Removal, Malware Removal, Computer Repair, Computer Service, Remote Support, Network Support, Database Development, Web Design, Backup Services, file sync, Consultation, Web Hosting, Email Services, Working with Partners such as Gillware, Efolder, Dell, HP, Group Spark, TCG, Rackspace, Square etc, .) services, including all technical support provided by Avanti Networks Inc., under the service option that you have selected. The Service may be referred to as, “Remote Computer Repair,” “Online Computer Repair,” “Remote Technical Support,” “Online Technical Support,” “Tech Support,” “Computer Support,” “Computer Repair Services.”, “Email Services,” “Data Backup,” “File Sync Services,” “POS Services,” “Credit Card Acceptance Services”, ”firewall Services,”, “and much more….
3. Pricing and Payments
Avanti Networks Inc. fees and charges for the service you select are provided to you during the ordering process and are available on the Avanti Networks Inc. web site unless otherwise provided for in this Agreement. You agree to pay the charges applicable to your selected service, as well as any, applicable taxes and other charges including but not limited to initial fees. You also agree to pay any additional charges or fees applied to your billing account for any reason, including but not limited to, interest, and charges due to insufficient credit or insufficient funds. IF customer has not made a payment and has not contacted Avanti Networks Inc. Within 120 Days, about the charges, He, She or Entity will be subject to collections and all fees associated with those fees.
3.1 Avanti Networks Inc. will make every reasonable attempt to troubleshoot, analyze, assess, correct or otherwise fix your computer, network or other problem. If Avanti Networks Inc. is unable to resolve your computer problem if it turns out to be hardware related, you may still be liable for charges for time spent by Avanti Networks Inc. in an attempt to correct a problem.
3.2 All payments are expected to be collected at the beginning of the Online Computer Repair call. The technician will calculate the total amount due based on the service fee. Upon completing the repairs, the technicians will explain to the customer what has been done and demonstrate that the problem described by the customer prior to the start of the repairs has been fixed.
3.3 If a technician discovers an un-foreseen computer problem which requires additional cost to fix and the customer declines the repairs, the payment for the original service is expected as calculated by the technician using the fixed rate.
3.4 Financial – Avanti Networks, Inc. gladly provides to Client a NO QUESTIONS ASKED 30 Day Money Back Guarantee. This includes all set-up fees and all moneys paid for services.
Client agrees that payment for services provided by Avanti Networks, Inc. is due 15 days after the date of invoice. All the payments must be in US dollars and be withdrawable against a bank in the United States.
Invoicing is by means of email or postal mail on request (limited to customers paying quarterly, semi-annually or annually). Client hereby agrees that Client understands payment is still due whether, or whether not they are in receipt of the invoice by these or any other means. Services rendered start upon date of account activation and continue until date of account cancellation.
The cancellation of services, with no penalty to Client, is only accepted by written letter, email or fax and is effective on the date received at the offices of Avanti Networks, Inc. The account will be pro-rated from the date of cancellation to the end of the monthly term. Any moneys paid by and due to Client from date of cancellation will be returned to Client by company check with-in 30 days of cancellation.
Client also agrees that failure of payment to be received by Avanti Networks, Inc 15 days of the date of invoicing may result in the interruption of services provided. Such interruption does not relieve the Client from the obligation to pay the monthly services charge. All returned checks from lack of funds will be liable for a $ 30.00 charge. If the Client defaults, the Client agrees to pay attorney and collection agency fees, incurred by Avanti Networks, Inc. in enforcing its rights under these terms and conditions. Upon account interruption the Client’s files, information, and mail under the Client’s account will be preserved, but will be none accessible, for up to 30 days after the interruption date. If payment is not received with-in this 30 day period, Avanti Networks, Inc has the right to delete these files, information and mail.
4. Limitation on liability
In no event shall Avanti Networks Inc. and/or its respective suppliers be liable for any consequential, direct, incidental, indirect, punitive, special or other similar damages or any damages resulting from loss of use, or loss of data, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of materials or services available from the site, even if the possibility of such damages could have been foreseen by Avanti Networks Inc. Avanti Networks Inc. is not responsible for any injuries sustained by users because of or as a result of any service.
5. Data Backup
It is your responsibility to back up all software and data that is stored on your computer’s hard disk drive(s) and/or on any other storage devices you may have prior to service performed on your computer. Avanti Networks Inc. and/or its third party service provider shall not be responsible at any time for any loss, alteration or corruption of any software, data or files.
Avanti Networks Inc. reserves the right to revise, amend, or modify this Terms of Service and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted on this website.
6. Data Backup Services
Are done by third Party Software and Services, Avanti Networks Inc. Will immediately try to fix a KNOWN issue and if there is a customer issue, Avanti Networks Inc. will inform the customer of the issue. The Customer can then at their own discretion, backup their own data, call a third party to do their backups, Terminate Avanti Networks Inc, at their pleasure or discretion, with a written statement or Email. At no time will Avanti Networks Inc. be liable for Data loss, and to loss work or profits, or the hiring of another Party or vendor to fix the work and their associated costs and fees. The customer also will also agree, by continual usage, that hackers, viruses, malware and general computer equipment failure will cause data loss, and will not hold Avanti Networks Inc. Liable in any way.
7. Email Services
Are done by third Party Software and Services, Avanti Networks Inc. Will immediately fix a KNOWN issue and if there is a customer issue, Avanti Networks Inc. will inform the customer of the issue. The Customer can then at their own discretion, backup their own email data, call a third party to do their backups, Terminate Avanti Networks Inc, at their pleasure or discretion, with a written statement or Email. At no time will Avanti Networks Inc. be liable for Data loss, and to loss work or profits, or the hiring of another Party or vendor to fix the work and their associated costs and fees. The customer also will also agree, by continual usage, that hackers, viruses, malware and general computer equipment failure will cause data loss, and will not hold Avanti Networks Inc. Liable in any way.
8. File Sync Services
Are done by third Party Software and Services, Avanti Networks Inc. Will immediately fix a KNOWN issue and if there is a customer issue, Avanti Networks Inc. will inform the customer of the issue. The Customer can then at their own discretion, backup their own data, call a third party to do their backups, Terminate Avanti Networks Inc, at their pleasure or discretion, with a written statement or Email. At no time will Avanti Networks Inc. be liable for Data loss, and to loss work or profits, or the hiring of another Party or vendor to fix the work and their associated costs and fees. The customer also will also agree, by continual usage, that hackers, viruses, malware and general computer equipment failure will cause data loss, and will not hold Avanti Networks Inc. Liable in any way.
9. Payment Processing services
Are through third Parties, No information is held at Avanti Networks Inc. Offices, Any Failure, Theft or loss of revenue is the responsibility of the third party and their services. Avanti Networks Inc. will intervene at customer request and help to the best of the companies’ ability. The customer will not hold Avanti Networks Inc or their employees liable in any way. The Customer can then at their own discretion, stop using the Payment Processing, call the third party to cancel or fix their account.
10. Overall Services
Terminate Avanti Networks Inc, at their pleasure or discretion, with a written statement or Email for being involved in the matter. At no time will Avanti Networks Inc. be liable for Data loss, and to loss work or profits, or the hiring of another Party or vendor to fix the work and their associated costs and fees. The customer also will also agree, by continual usage, that hackers, viruses, malware and general computer equipment failure will cause data loss, and will not hold Avanti Networks Inc. Liable in any way.
